These Terms of Service ("Terms") are a legally binding agreement between you and Prosta Solutions LLC governing your access to and use of the prosta.app website (including prosta.uz, which redirects to it), the Prosta mobile applications, and all related services (collectively, the "Platform" or "Service"). By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
"Platform" — the prosta.app website (the domain prosta.uz redirects to it), the Prosta mobile applications for iOS and Android, and any related software, APIs, widgets, and services operated by Prosta.
"Customer" — a natural person who uses the Platform to search for, book, pay for, or review Services offered by Providers.
"Provider" (or "Business Owner", "Partner") — a legal entity, individual entrepreneur, self-employed person, or organization that lists and offers beauty, wellness, lifestyle, home, or related services through the Platform.
"Services" — the beauty, wellness, spa, barbering, nail, massage, fitness, lifestyle, home, and other services offered by Providers to Customers. Services are rendered by Providers, not by Prosta.
"Booking" — an appointment request made by a Customer through the Platform and accepted (automatically or manually) by a Provider.
"Content" — any text, photos, videos, reviews, ratings, descriptions, prices, logos, or other materials uploaded to or displayed on the Platform.
"Payment Providers" — licensed third-party payment service providers integrated with the Platform from time to time. The current list of available payment methods is shown at checkout.
Marketplace role. Prosta operates an information and technology platform that connects Customers with independent Providers. Prosta acts solely as an intermediary and information aggregator. Prosta does not itself provide beauty, wellness, or any other underlying Services, does not employ Providers or their staff, and is not a party to the service contract between a Customer and a Provider.
Contract between Customer and Provider. When a Booking is confirmed, a direct contract for the provision of Services arises exclusively between the Customer and the Provider. The Provider is solely responsible for the quality, safety, legality, timing, and outcome of the Services.
No agency. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between Prosta and any Customer or Provider, except that Prosta may act as a limited payment collection agent for Providers where payments are processed through the Platform.
No endorsement. Prosta does not verify, endorse, or guarantee the qualifications, licenses, or performance of any Provider, and the presence of a Provider on the Platform does not constitute a recommendation.
Age. You must be at least 16 years old to use the Platform. Persons aged 16–18 may use the Platform only to the extent permitted by applicable law and, where required, with the consent of a parent or legal guardian.
Passwordless sign-in; account creation. The Platform does not use passwords. You sign in using a one-time code (OTP) sent to your email or phone number, or through your Telegram, Google, or Apple ID account. There is no separate registration form: your first successful sign-in automatically creates your account, and each subsequent sign-in with the same verified identifier gives you access to that same account. By signing in for the first time you accept these Terms and the Privacy Policy. You agree to provide accurate, current, and complete information (such as your name) and to keep it updated.
One account. You may maintain only one Customer account. Creating multiple accounts (for example, using different sign-in identifiers) to abuse promotions, evade suspensions, manipulate reviews, or circumvent fees is prohibited and grounds for termination of all associated accounts without refund.
Account security. Access to your account is controlled by access to your email inbox, phone number, Telegram, Google, or Apple ID account. You are solely responsible for keeping those channels and devices secure and for all activity under your account, and you must not share one-time codes with anyone — Prosta staff will never ask for your OTP. You must notify us immediately at support@prosta.uz of any suspected unauthorized use or loss of control over a linked sign-in channel. Prosta is not liable for losses arising from unauthorized access caused by your failure to secure your sign-in channels or devices.
Verification. Prosta may, at its discretion, require identity, business registration, license, or other verification from Providers (including TIN, business registration certificates, and licenses where applicable) and may suspend accounts pending verification.
Refusal of registration. Prosta reserves the right to refuse registration or restrict access to any person at its sole discretion, to the extent permitted by law.
Bookings. The Platform allows you to search for Providers and request Bookings. A Booking is confirmed only when accepted by the Provider (automatically or manually) and confirmed through the Platform. Availability shown on the Platform is provided by Providers and may contain errors; Prosta does not guarantee availability.
Accuracy of listings. Prices, durations, photos, and service descriptions are provided by Providers. The final price may differ where the scope of work changes at the appointment (for example, additional length, complexity, or materials), which is a matter strictly between you and the Provider.
Attendance. You agree to arrive on time for confirmed Bookings. Providers may refuse or shorten service, or apply a late fee or no-show fee, in accordance with their published policies, if you arrive late or fail to attend.
Cancellations by Customer. Each Provider sets its own cancellation window and policy, displayed on its profile or at checkout. By completing a Booking you accept the Provider's cancellation policy. Late cancellations and no-shows may result in a cancellation fee, forfeiture of a prepayment or deposit, or restrictions on future Bookings.
Cancellations by Provider. Providers may cancel or reschedule Bookings (for example, due to staff illness). In such cases any prepayment made through the Platform for the cancelled Booking will be refunded in accordance with Section 8, but Prosta is not liable for any other loss, inconvenience, or expense arising from a Provider's cancellation.
No-show and repeated abuse. Repeated no-shows, late cancellations, abusive behavior toward Providers or staff, or fraudulent Bookings may result in warnings, booking restrictions, mandatory prepayment requirements, or account termination.
Reviews and ratings. You may leave reviews only for Services you actually received through the Platform. Reviews must be honest, based on genuine personal experience, and must not contain unlawful, defamatory, obscene, discriminatory, or commercially misleading content. Prosta may, at its sole discretion, moderate, refuse to publish, or remove any review that violates these Terms, and may verify reviews against Booking records. Prosta does not guarantee publication of any review.
Health disclosure. You are responsible for disclosing to the Provider any allergies, medical conditions, pregnancy, skin sensitivities, or contraindications relevant to the Service. Prosta bears no responsibility for adverse reactions or health outcomes.
Personal use. Customer accounts are for personal, non-commercial use. Booking on behalf of another person is permitted only with that person's consent, and you are responsible for the accuracy of their details.
Business profile. You are responsible for the accuracy, completeness, and lawfulness of your profile, including business name, address, services, prices, durations, staff, photos, and operating hours, and for keeping availability up to date. Prices displayed to Customers must be genuine and inclusive of all mandatory charges except those clearly disclosed.
Service delivery. You must honor all confirmed Bookings and provide Services with the quality, scope, and timing described in your profile. Systematic cancellations, quality complaints, or failure to honor Bookings may result in ranking penalties, suspension, or termination.
Legal compliance. You represent and warrant that you: (a) are duly registered to conduct business under the laws of your jurisdiction (as a legal entity, individual entrepreneur, or self-employed person); (b) hold all licenses, permits, certificates, and sanitary approvals required for your Services; (c) comply with all applicable laws, including consumer protection, sanitary-epidemiological, tax, employment, and advertising laws; and (d) will provide Customers with any legally required receipts or fiscal documents. You are solely responsible for calculating, reporting, and paying all taxes on your income.
Subscription fees. Access to Provider features requires a paid subscription per the pricing published on the Platform or agreed in your subscription agreement. Fees are billed in advance monthly or annually, are exclusive of taxes unless stated otherwise, and are non-refundable except as required by mandatory law. Prosta may change subscription prices with at least 30 days' notice; continued use after the effective date constitutes acceptance.
Commission. Prosta may charge a commission on Bookings and/or payments processed through the Platform, at the rates specified in your subscription agreement or the Platform's published tariffs. Prosta may deduct commissions and fees from amounts collected on your behalf before settlement.
Settlements. Where payments are processed through the Platform, Prosta (via Payment Providers) will remit collected amounts to you, net of commissions, fees, refunds, and chargebacks, within the settlement period specified in your agreement. Prosta may withhold or set off amounts subject to disputes, chargebacks, suspected fraud, or regulatory requirements.
Customer data. Customer personal data received through the Platform may be used only to fulfill the specific Booking and for legally required purposes. You must not: (a) use Customer data for marketing outside the Platform without the Customer's separate lawful consent; (b) export, sell, or share Customer data with third parties; or (c) solicit Customers to book or pay outside the Platform in order to avoid Platform fees ("circumvention"). Circumvention is a material breach and grounds for immediate termination and recovery of avoided fees.
Staff. You are responsible for your staff members' use of the Platform and their compliance with these Terms, and for the lawfulness of their engagement (employment or civil contracts).
Insurance and liability. You are solely liable for any harm caused to Customers in connection with your Services, including personal injury, allergic reactions, property damage, and defective results, and you are encouraged to maintain appropriate insurance. You will indemnify Prosta per Section 13.
Promotions. If you offer discounts or participate in Platform promotions, you must honor the promoted prices and conditions for the promotion period.
Payment methods. Payments may be made: (a) directly to the Provider at the venue (cash or the Provider's own terminal); or (b) through the Platform via licensed Payment Providers, where online payment is available. Available methods may vary by Provider and region and are shown at checkout.
Payment processing. Online payments are processed by licensed third-party Payment Providers. Prosta does not collect or store full payment card details. Card data is handled by the Payment Providers in accordance with their own terms and PCI DSS requirements. By paying online you also accept the applicable Payment Provider's terms.
Authorization. By providing a payment method you represent that you are its lawful holder or authorized user. Prosta and Payment Providers may run anti-fraud checks and decline or reverse transactions that appear fraudulent or unlawful.
Currency. All prices on the Platform are in Uzbek som (UZS) unless expressly stated otherwise. Where services are offered in other countries, prices may be displayed in the applicable local currency.
Prepayments and deposits. Providers may require full or partial prepayment or a deposit to confirm a Booking. Prepayment terms are shown at checkout and form part of the Booking contract between the Customer and the Provider.
Fiscal documents. The Provider is responsible for issuing any legally required fiscal receipt for the Services. Where Prosta charges its own fees (subscriptions, commissions), Prosta issues the corresponding documents for its fees only.
Provider-set policies. Each Provider sets and publishes its own cancellation window (for example, free cancellation up to 24 hours before the appointment). The applicable policy is shown on the Provider's profile and/or at checkout and forms part of the Booking.
Default rule. If a Provider has not published a cancellation policy, the default rule is: free cancellation up to 3 hours before the appointment start time; later cancellations and no-shows may forfeit any prepayment.
How to cancel. Cancellations must be made through the Platform (or, where unavailable, by directly notifying the Provider) before the applicable deadline. The time of cancellation recorded by the Platform is decisive.
Force majeure. Where a Booking cannot be fulfilled due to circumstances beyond the parties' reasonable control (natural disaster, government restrictions, utility failure, etc.), the Booking may be cancelled without fees and any Platform-processed prepayment refunded under Section 8.
Refunds for Services. Because Services are provided by Providers, refund claims for Services (quality, non-performance, dissatisfaction) must be addressed to the Provider, who is responsible for resolving them in accordance with its own policy and applicable consumer protection law. Prosta may, at its discretion, assist in communication between the parties but has no obligation to issue refunds for Services from its own funds.
Refunds of Platform-processed prepayments. A prepayment processed through the Platform will be refunded to the original payment method where: (a) the Provider cancels the Booking; (b) the Customer cancels within the free-cancellation window; (c) the Booking fails due to a verified technical error of the Platform; or (d) a refund is agreed by the Provider or required by mandatory law.
Refund processing. Approved refunds are initiated within 10 business days of approval. The time for funds to reach your account depends on the Payment Provider and issuing bank (typically 3–15 business days) and is outside Prosta's control. Refunds are made in the original currency and to the original payment method; where technically impossible, an alternative method may be agreed.
Non-refundable amounts. Unless mandatory law provides otherwise, the following are non-refundable: (a) Provider subscription fees (whole or partial periods); (b) prepayments forfeited under the applicable cancellation policy after the deadline or for no-shows; (c) Platform service fees and commissions on completed Bookings; (d) promotional credits, bonuses, and vouchers, which have no cash value.
Chargebacks. If you initiate a chargeback for a transaction, we may suspend your account pending investigation. Unjustified chargebacks constitute a breach of these Terms, and we may recover related costs and re-invoice the underlying amount.
Disputes. Payment disputes should first be reported to support@prosta.uz with the Booking number and details. We will review within 10 business days and coordinate with the Provider and Payment Provider as needed.
You agree not to:
use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
impersonate any person or entity or misrepresent your identity, affiliation, qualifications, or licenses;
post false, misleading, defamatory, obscene, discriminatory, extremist, or otherwise unlawful Content, or fake reviews (including reviews of your own business or a competitor's business);
harass, abuse, threaten, discriminate against, or intimidate any user, Provider, staff member, or Prosta employee;
make Bookings with no intention of attending, or otherwise abuse the booking system;
circumvent the Platform, its fees, or its payment flows, including soliciting off-platform bookings or payments for Customers acquired through the Platform;
scrape, crawl, harvest, copy, or systematically extract data from the Platform (including Provider listings, prices, and reviews) by automated or manual means without our prior written consent;
reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform, or interfere with its security features;
upload or transmit viruses, malware, or other malicious code, or interfere with or disrupt the Platform, its servers, or networks;
collect, store, or process other users' personal data except as expressly permitted by these Terms;
use the Platform to advertise third-party products or services without our written consent, or send spam through Platform messaging;
resell, sublicense, or commercially exploit the Platform or access to it without a written agreement with Prosta.
Violation of this Section may result in immediate suspension or termination, removal of Content, forfeiture of promotional balances, notification of law enforcement, and claims for damages.
Platform ownership. The Platform, including its software, design, interfaces, databases, algorithms, text, graphics, logos, and trademarks (including "Prosta", "prosta.app", "prosta.uz" and associated marks), is owned by Prosta Solutions LLC or its licensors and protected by intellectual property laws of Uzbekistan and international treaties. No rights are granted except the limited right to use the Platform under these Terms.
License to you. Prosta grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for its intended purpose. This license terminates when your account is terminated.
Your Content. You retain ownership of Content you upload. By uploading Content, you grant Prosta a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, use, reproduce, adapt, translate, modify, publish, publicly display, and distribute such Content for the purposes of operating, improving, promoting, and marketing the Platform, in any media, for the duration of protection of the relevant rights. This license survives account deletion with respect to Content already incorporated into Platform materials (e.g., anonymized reviews, marketing assets), to the extent permitted by law.
Content warranties. You represent that you own or have all necessary rights to the Content you upload (including model releases for photos of persons) and that it does not infringe third-party rights. You are solely liable for your Content.
Moderation. Prosta may (but is not obliged to) monitor, moderate, edit for format, refuse, or remove any Content at its discretion, including Content that violates these Terms or applicable law.
Feedback. If you send us ideas, suggestions, or feedback, we may use them freely without compensation or attribution.
DMCA-style claims. Rights holders may report alleged infringement to support@prosta.uz with proof of rights; we will review and act as appropriate.
The Platform may include AI-powered features, such as AI-assisted look visualization, recommendations, and automated booking assistance ("AI Features"). AI Features generate outputs automatically and may be inaccurate, incomplete, or not representative of real-world results (for example, a generated hairstyle preview may differ from the achievable result).
AI outputs are provided for informational and entertainment purposes only, do not constitute professional, medical, or cosmetological advice, and do not form part of the contract with a Provider unless expressly confirmed by the Provider.
By using AI Features that process your photos, you consent to the processing of the uploaded images for the purpose of generating the requested output, as described in the Privacy Policy. You must not upload photos of third parties without their consent, or unlawful images.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Prosta does not warrant that the Platform will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components. We may suspend the Platform for maintenance, updates, or technical reasons.
Prosta is not responsible for: (a) the acts, omissions, quality, safety, legality, or results of Providers or their Services; (b) the accuracy of Provider-supplied information; (c) the conduct of Customers; (d) the operation of Payment Providers, telecom operators, app stores, or other third parties; (e) Content posted by users.
To the maximum extent permitted by applicable law, Prosta, its founders, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, goodwill, data, or business opportunity, arising out of or relating to the Platform or these Terms, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, Prosta's total aggregate liability to you for all claims arising out of or relating to the Platform or these Terms shall not exceed the greater of: (a) the total fees actually paid by you to Prosta in the 12 months preceding the event giving rise to the claim; or (b) 1,000,000 UZS.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of the law of the Republic of Uzbekistan, including mandatory consumer rights.
Indemnification. You agree to indemnify, defend, and hold harmless Prosta and its founders, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms; (b) your Content; (c) your violation of any law or third-party rights; and, for Providers, (d) your Services, your staff, your tax obligations, and any harm caused to Customers.
Termination by you. You may stop using the Platform at any time and may delete your account: (a) in the app via Settings → Account → Delete Account; (b) via the web deletion page at [prosta.app/delete-account]; or (c) by emailing support@prosta.uz from your registered email. Deletion requests are processed within 30 days.
Effect of Customer deletion. Upon deletion, your profile and personal data are deleted or anonymized in accordance with the Privacy Policy, except data we must retain by law (e.g., payment and accounting records) or need for the establishment, exercise, or defense of legal claims. Confirmed future Bookings should be cancelled before deletion; outstanding fees remain payable.
Effect of Provider termination. Provider termination does not relieve the Provider of obligations to honor confirmed Bookings, pay outstanding fees and commissions, or complete settlements. Unused subscription periods are not refunded except as required by mandatory law.
Termination or suspension by Prosta. We may suspend, restrict, or terminate your account, remove Content, cancel Bookings, and withhold settlements, immediately and without prior notice, if: (a) you breach these Terms or applicable law; (b) we suspect fraud, abuse, or a security risk; (c) required by law, a regulator, or a Payment Provider; (d) your account is inactive for more than 24 consecutive months; or (e) we discontinue the Platform or a part of it. Where reasonably practicable and lawful, we will give notice.
Survival. Sections concerning intellectual property, indemnification, limitation of liability, governing law, and any accrued payment obligations survive termination.
By registering, you consent to receive transactional communications necessary for the Service (booking confirmations, reminders, changes, security notices) via SMS, push notifications, email, and messaging apps. These cannot be opted out of while your account is active, as they are integral to the Service.
Marketing communications are sent only with your consent, which you may withdraw at any time via account settings or the unsubscribe mechanism in the message. Withdrawal does not affect transactional communications.
Legal notices from Prosta may be delivered via the Platform, email to your registered address, or publication on the Platform, and are deemed received when sent or published.
We continuously develop the Platform and may add, change, or remove features at any time without liability, provided this does not deprive Providers of the core paid functionality for the paid period without compensation.
We may amend these Terms. Material changes will be announced by posting the updated Terms with a new "Last updated" date and, where the changes materially affect your rights, by in-app notice or email at least 10 days before the effective date. Your continued use of the Platform after the effective date constitutes acceptance. If you do not agree, you must stop using the Platform and may delete your account.
These Terms and any non-contractual obligations arising out of them are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-law rules and, to the extent permitted, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory pre-trial procedure. Before filing any claim, the parties must attempt resolution through a written claim (pretenziya) sent to support@prosta.uz or to your registered contact details. The receiving party shall respond within 15 business days. Court proceedings may be initiated only after this procedure is exhausted.
Subject to mandatory rules on consumer jurisdiction, all disputes arising out of or in connection with these Terms or the Platform shall be resolved by the competent courts of Tashkent, Republic of Uzbekistan. Disputes with Providers acting as businesses shall be resolved by the economic courts of Tashkent.
Any claim must be brought within one year of the event giving rise to it, unless a longer period is mandated by law.
Entire agreement. These Terms, the Privacy Policy, and any subscription or partner agreement between you and Prosta constitute the entire agreement regarding the Platform. In case of conflict, a signed individual agreement prevails over these Terms for the relevant party.
Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force.
No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.
Assignment. You may not assign these Terms or your account without our written consent. Prosta may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you.
Force majeure. Prosta is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, war, civil unrest, epidemics, government acts, internet or utility failures, and failures of third-party services.
Language. These Terms may be published in Uzbek, Russian, and English. In case of discrepancy, the [Russian] version prevails, except where mandatory law requires otherwise.
App stores. Use of the mobile applications is additionally subject to the applicable rules of Google Play and the Apple App Store. Apple and Google are not parties to these Terms and bear no responsibility for the Platform.
